Terms of Service
Homeboys helps men 30 and over in Taipei discover local activities and make friends in person. We built this for one reason: adult male friendship is hard to start, and shoulder-to-shoulder beats face-to-face. These Terms are how we keep that mission honest.
1. Agreeing to these Terms
By creating an account, signing in, or using the Homeboys mobile app or the homeboys.app website (together, the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
You must be at least 18 years old and able to enter into a binding contract under the laws of your country of residence. The Service is optimized for users in Taiwan but is not restricted to Taiwan residents. You are responsible for following the laws that apply to you where you live and where you meet up.
These Terms work alongside our Privacy Policy, which describes what we collect and why. Together they form the full agreement between you and Incultnito LLC.
2. Who can use Homeboys
To open and keep an account, you must:
- Be 18 or older.
- Identify as male. Homeboys exists for men's friendships; that is the entire premise of the product. We don't ask for documents, but the community is built on this expectation.
- Not be currently banned from the Service.
- Provide accurate signup information. Use one account per person.
- Complete selfie verification before hosting any activity, and phone verification before hosting evening activities (defined as activities starting between 9pm and 5am Taipei time).
We may decline service, refuse new accounts, or terminate existing ones at our discretion if any of these conditions stop being true.
3. Your account
You are responsible for your account. That means:
- Keep your password or sign-in credentials private. Don't share them.
- Don't let other people use your account. One person, one account.
- Tell us promptly at [email protected] if you think your account has been compromised.
- Anything done from your account is treated as done by you.
You can sign out at any time from the Profile tab. Account deletion is handled by request to [email protected]; we will purge your data per the schedule in the Privacy Policy. (We're a small team and a self-serve delete button is on the roadmap.)
4. Identity verification
Trust is the whole product. We use two verification gates:
- Selfie verification. A live selfie compared by an automated vision check. Required before you can host an activity. Earns you a verified badge visible to other members.
- Phone verification. A one-time SMS code to a Taiwan phone number. Required before you can host evening activities and before direct messages unlock.
Submitting a fake selfie, someone else's selfie, a borrowed phone, or otherwise misrepresenting your identity is grounds for immediate, permanent removal. Verification confirms that a real person sat in front of a real camera at a real moment. It is not a background check, criminal record check, or guarantee of anyone's intentions or safety. Treat verified members the way you would treat any new acquaintance.
5. What you can post
Homeboys is for organizing real-world activities — pickup basketball, hiking, board game nights, language exchanges, hotpot, that kind of thing. When you create an activity, write a chat message, or fill in your profile, the following must be true:
- The activity is real, you intend to host or attend it, and the location and time are accurate.
- You have the right to post the content (photos, text, venue details). Don't lift other people's photos or write-ups.
- The content is suitable for a general adult audience and is consistent with a friendship app, not a dating, hookup, or marketplace app.
Do not post or send:
- Sexual content, sexual solicitation, romantic pursuit, or anything framed as a date. This includes flirty one-on-one invitations. We screen for dating-coded language in both English and 中文.
- Harassment, hate speech, slurs, threats, doxing, or content targeting any group based on race, religion, nationality, sexuality, gender identity, or disability.
- Illegal acts, including drugs (beyond legal alcohol/tobacco context), weapons, child sexual abuse material, human trafficking, or any content that violates Taiwan or applicable law.
- Scams, phishing, multi-level marketing, paid promotions, recruiting for other apps, or commercial activity unless we've given written permission.
- Spam, automated content, bot-generated text, or off-topic posts (politics, religion campaigning, crypto pumps).
- Personal information of others without consent (phone numbers, addresses, employer details).
- Content that impersonates another person, brand, or organization.
We can remove any content, lock any activity, or suspend any account at our discretion when content crosses these lines. We don't owe you advance notice for removals.
6. Hosting an activity
Hosting is a responsibility, not just a feature. When you host:
- You are the organizer of a real meetup, in a real venue, with real people. Pick a public, sensible location.
- Show up on time. If you can't, cancel early.
- Be welcoming to everyone who joins. No gatekeeping based on background, body type, or English ability.
Cancellation and strikes. You can cancel an activity you're hosting at any time. If you cancel within 24 hours of the scheduled start time, the system records a host strike against your account. Strikes accumulate. Repeated late cancellations may result in restrictions on your ability to host or in account suspension. The strike system is automated and runs server-side.
You are responsible for your event. Incultnito LLC is not the organizer of your activity. We provide the tool you used to gather people. What happens before, during, and after the event — including safety, conduct, costs, legal compliance with venue rules, and consequences of attendance — is between the host, the attendees, and the venue.
7. Meeting in person — your responsibility
Homeboys exists to push you off the screen and into real life. Meeting strangers in person carries real-world risk that we cannot remove, no matter how good our verification is.
You agree that you attend any in-person activity entirely at your own risk. Incultnito LLC does not vet attendees beyond basic identity verification, does not supervise events, does not control venues, and is not liable for what happens at a meetup, before it, or after it. This includes (without limitation) personal injury, theft, harassment, illness, financial loss, or any dispute between you and another user.
8. Reports, moderation, and enforcement
You can report any user, message, or activity from inside the app using the Report flow. Reports go to our moderation queue.
How moderation actually works, plainly:
- Every chat message is automatically screened at send time using OpenAI's moderation API plus our own keyword filters for dating-coded language and harm threats. Some messages are blocked before delivery.
- Reports are reviewed by a human (currently the operator) on a best-effort basis. Severe reports are prioritized.
- We do not pre-screen every piece of content on the platform. Activity titles, descriptions, and profile fields rely on automated filters and reactive review after a report.
- We may remove content, hide activities, suspend accounts, ban devices, or refuse service for any reason consistent with these Terms, with or without prior notice.
Repeat offenders are removed permanently. We may also report illegal activity to the appropriate authorities.
9. Ending your use
You can stop using Homeboys at any time. Sign out from the Profile tab, or email [email protected] to request account deletion.
We may suspend or terminate your account at any time if you violate these Terms, abuse the Service, put other users at risk, or engage in illegal activity. We may also wind down the Service entirely with reasonable notice in the app.
When your account ends, your data is handled per our Privacy Policy. Some content may survive (e.g., messages other people received, reports filed against you, records we need to keep for safety or legal reasons).
10. Your content; our trademarks
You keep the rights to the content you post — your activity descriptions, photos, profile text, messages. You're not selling anything to us.
By posting content on Homeboys, you grant Incultnito LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, transmit, translate, adapt for display, and otherwise use that content for the purpose of operating, improving, and promoting the Service. This license ends when the content is deleted from our systems, except for backups and copies retained for safety, legal, or reasonable operational reasons.
You represent that you have the rights to grant this license — that the content is yours, or you have permission, and that posting it doesn't violate anyone else's rights.
The names Homeboys, 老友, the homeboys.app domain, and the app's logos and visual design are trademarks of Incultnito LLC. You may not use them without our written permission, except to refer to the Service itself.
11. The Service is free, for now
Homeboys is currently free to use. There are no in-app purchases, no subscription fees, no paid tiers. If we ever introduce paid features, we will give clear, in-app notice before they start applying to you, and free features that you've been using will continue to be available in some reasonable form.
12. Service "as is"; no warranties
We work on Homeboys with care, but we cannot promise it will be perfect, always available, or free of bugs. To the maximum extent allowed by law:
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, accuracy, non-infringement, or that the Service will be uninterrupted, error-free, secure, or free from harmful components.
- We make no guarantee about the conduct of any user, online or in person, or that any user is who they say they are despite our verification gates.
- We make no guarantee about what happens at any activity posted on the Service.
- Verification, moderation, and reporting tools are best-effort, not infallible. They will sometimes miss things and sometimes block things they shouldn't.
13. Limitation of liability
To the maximum extent allowed by law, Incultnito LLC and its officers, members, employees, and contractors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible loss, arising out of or relating to your use of the Service or any in-person meetup organized through it.
For any direct damages we are found liable for, our total combined liability to you for all claims is capped at the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) US$100. Since the Service is currently free, this typically means US$100.
Some jurisdictions don't allow certain limitations of liability. If a court decides one of the above limits doesn't apply to you, the remaining limits still apply to the fullest extent allowed.
14. You indemnify us for misuse
You agree to defend, indemnify, and hold harmless Incultnito LLC and its officers, members, employees, and contractors from any claim, demand, loss, or expense (including reasonable legal fees) brought by a third party and arising out of: (a) your use of the Service in violation of these Terms or applicable law; (b) content you posted; (c) your conduct at, before, or after any in-person activity; or (d) your violation of anyone else's rights.
15. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws principles. Incultnito LLC is registered in Wyoming.
If we have a dispute, let's try to resolve it directly first. Email [email protected]. If we can't work it out within 30 days, the dispute will be resolved by binding individual arbitration administered under the rules of a recognized arbitration institution agreed by both sides, seated in Wyoming or by remote hearing. You and we both waive jury trial and class actions.
Small-claims carve-out: nothing in this section stops either side from bringing an individual claim in a small-claims court of competent jurisdiction, including in Taiwan where you reside, as long as the case stays in small-claims court and on an individual basis.
If applicable consumer-protection law in your country of residence gives you stronger rights than these Terms, those rights still apply to you.
16. Changes to these Terms
We may update these Terms from time to time — for new features, legal updates, or because we got something wrong. When we make a material change, we will post the updated Terms here with a new effective date and notify you in the app at least 14 days before the change takes effect, unless the change is required for legal or security reasons sooner. Continued use of the Service after the new effective date means you accept the updated Terms.
17. Other terms
- Entire agreement. These Terms plus the Privacy Policy are the entire agreement between you and us for your use of the Service.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. If we don't enforce something right away, we haven't given up our right to enforce it later.
- Assignment. You can't assign these Terms without our consent. We can assign them to a successor of our business.
- Notices. We may contact you in-app, by push notification, or by email at the address on your account.
- Headings. Section headings are for convenience only.

老友 Homeboys 幫助 30 歲以上的男性在台北透過在地活動結交真實朋友。我們做這個 app 只有一個理由：成年男性的友誼很難開始，肩並肩比面對面好太多。這份條款是我們守住這個初心的方式。
一、同意這份條款
當你建立帳號、登入或使用老友 Homeboys 行動應用程式或 homeboys.app 網站（合稱「本服務」），即表示你同意這份服務條款。如不同意，請勿使用本服務。
你必須年滿 18 歲，並依你居住國法律具有訂立契約之行為能力。本服務針對台灣使用者最佳化，但不限定僅供台灣居民使用。你必須遵守你所在地及聚會所在地的相關法律。
本條款應與我們的隱私權政策一併閱讀，後者說明我們蒐集哪些資料、為何蒐集。兩者構成你與 Incultnito LLC 之間完整的契約。
二、誰可以使用
要建立並保有帳號，你必須：
- 年滿 18 歲。
- 自我認同為男性。本產品為男性友誼而設計，這是整個產品的前提。我們不查證件，但社群建立在這份信任之上。
- 目前未遭本服務封禁。
- 註冊資料正確真實。一人一帳號。
- 於主辦任何活動前完成自拍驗證；於主辦夜間活動（台北時間晚上 9 點至凌晨 5 點開始的活動）前完成手機號碼驗證。
若上述任一條件不再成立，我們得自行決定拒絕服務、拒絕新註冊或終止既有帳號。
三、你的帳號
你必須對自己的帳號負責：
- 密碼或登入憑證請妥善保管，不要分享。
- 不得讓他人使用你的帳號。一人一帳號。
- 若懷疑帳號遭盜用，請立即寫信至 [email protected] 通知我們。
- 任何從你帳號發出的行為，視為你本人所為。
你可隨時於「個人檔案」分頁登出。刪除帳號目前需來信 [email protected] 申請，我們會依隱私權政策所列時程清除資料。（我們是小團隊，app 內自助刪除功能正在開發中。）
四、身分驗證
信任是本服務的核心。我們設兩道驗證：
- 自拍驗證：現場拍攝自拍，由自動視覺辨識比對。主辦活動前必須通過。通過後會在個人檔案顯示「已驗證」徽章。
- 手機驗證：對台灣手機號碼發送一次性簡訊驗證碼。主辦夜間活動及開啟一對一私訊功能前必須通過。
提交假自拍、他人自拍、借用的手機或以任何方式虛偽陳述身分者，將立即且永久移除帳號。驗證僅確認在某一時刻有一個真人坐在攝影機前，並非身家調查、犯罪紀錄查核，亦不保證任何人之意圖或人身安全。請將已驗證會員視為任何新認識的朋友，自行判斷。
五、你可以張貼什麼
老友 Homeboys 是用來揪實體活動的——鬥牛、爬山、桌遊夜、語言交換、火鍋等等。當你建立活動、發送訊息或填寫個人檔案時，必須符合以下要求：
- 活動是真的，你也真的打算主辦或參加，地點、時間屬實。
- 你有權利張貼該內容（照片、文字、場地資訊）。請勿盜用他人照片或文案。
- 內容適合一般成年觀眾，並符合「友誼 app」的定位，而非交友、約炮或商業推銷 app。
請勿張貼或傳送：
- 性內容、性招攬、追求、約會邀約。包含「就我們兩個」的曖昧邀請。我們會以中英雙語篩選交友/曖昧用語。
- 騷擾、仇恨言論、歧視性用語、威脅、人肉搜索，或針對特定族群（種族、宗教、國籍、性傾向、性別認同、身心障礙）的攻擊性內容。
- 違法行為，包括毒品（合法菸酒情境外）、武器、兒少性剝削內容、人口販運，或任何違反台灣或其他適用法律的內容。
- 詐騙、釣魚、多層次傳銷、付費置入、為其他 app 拉人，未經我們書面同意之商業活動。
- 垃圾訊息、自動化內容、機器人生成文字、離題內容（政治宣傳、宗教傳教、加密貨幣推坑）。
- 未經他人同意公開他人個資（電話、地址、雇主資訊）。
- 冒充他人、品牌或組織之內容。
內容逾越上列界線時，我們得自行決定移除任何內容、鎖定任何活動或停權任何帳號，且無事先通知義務。
六、主辦活動
主辦活動是責任，不只是功能。當你主辦：
- 你是真實聚會的召集人，地點是真實場地，參加者是真人。請選擇公共、合理的場地。
- 準時出現。若無法出席，請提早取消。
- 對加入的每個人友善。不要因背景、體型或英文程度設門檻。
取消與警示（strike）：你可以隨時取消自己主辦的活動。若於排定開始時間前未滿 24 小時取消，系統會在你的帳號上記一個主辦警示（host strike）。警示會累積。多次臨時取消可能導致主辦權限受限或帳號停權。警示機制由伺服器自動執行。
你對自己的活動負責。Incultnito LLC 不是你活動的主辦人，我們只提供你召集人的工具。活動前、中、後發生的一切——包含安全、行為、費用、場地規定之合規、出席之後果——皆屬於主辦人、參加者與場地之間的事。
七、實體聚會——你自負風險
老友 Homeboys 的目的就是把你從螢幕推向真實生活。與陌生人實體見面有真實風險，再好的驗證系統也無法完全排除。
你同意參加任何實體活動完全自負風險。Incultnito LLC 除基礎身分驗證外不審查參加者、不監督現場、不控制場地，對聚會發生前、中、後之任何事項概不負責，包括但不限於人身傷害、財物損失、騷擾、疾病、金錢損失，或你與其他使用者之間之任何爭議。
八、檢舉、審核與處置
你可在 app 內透過檢舉流程舉報任何使用者、訊息或活動。檢舉會進入我們的審核佇列。
審核實際的運作方式，老實說：
- 每則聊天訊息發送時都會自動篩查，使用 OpenAI 內容審核 API 並加上我們自己的關鍵字過濾（含交友用語、傷害威脅）。部分訊息會在送達前被攔下。
- 檢舉由真人審核（目前由營運者本人），以盡力而為方式處理，嚴重檢舉優先。
- 我們不會對所有內容進行事前審查。活動標題、敘述、個人檔案欄位主要靠自動過濾與檢舉後的反應式審核。
- 我們得依本條款移除內容、隱藏活動、停權帳號、封禁裝置或拒絕服務，無須事先通知。
累犯永久移除。涉及違法行為者，我們可能通報相關機關。
九、結束使用
你可隨時停止使用本服務。從「個人檔案」分頁登出，或寫信至 [email protected] 申請刪除帳號。
若你違反本條款、濫用服務、危及其他使用者或從事違法行為，我們得隨時停權或終止你的帳號；亦得於 app 內合理通知後全面終止本服務。
帳號終止後，你的資料依隱私權政策處理。部分內容可能繼續存在（例如他人已收到的訊息、針對你的檢舉紀錄、安全或法律所需之紀錄）。
十、你的內容；我們的商標
你張貼的內容（活動敘述、照片、個人檔案文字、訊息）所有權仍屬於你，你並未把任何權利賣給我們。
當你在老友 Homeboys 張貼內容，即授予 Incultnito LLC全球性、非專屬、免權利金、可再授權的授權，允許我們為營運、改進及推廣本服務之目的，得以代管、儲存、顯示、傳輸、翻譯、調整顯示及以其他方式使用該內容。授權於該內容從我們系統移除時終止，惟為安全、法律或合理營運所需之備份與副本除外。
你聲明你有權授予上述授權——內容為你所有，或你已獲授權，且張貼該內容未侵害他人權利。
Homeboys、老友、homeboys.app 網域及 app 標誌與視覺設計，皆為 Incultnito LLC 之商標。除指稱本服務本身外，未經我們書面同意不得使用。
十一、目前免費
老友 Homeboys 目前免費使用，無任何 in-app 付費、訂閱費或付費方案。若未來推出付費功能，我們會在 app 內清楚事先通知，且你既有在用的免費功能仍會以合理形式繼續提供。
十二、服務「依現狀」提供；不擔保
我們認真經營，但無法保證服務完美、永遠可用或毫無錯誤。於法律允許之最大範圍內：
- 本服務以「現狀」及「現有」方式提供，不附帶任何明示或默示之擔保——包括可商售性、特定用途適合性、正確性、不侵權，或服務不中斷、無錯誤、安全、無有害成分等擔保。
- 我們對任何使用者線上或實體之行為不作擔保，亦不保證任何使用者確為其所聲稱之身分（即便通過驗證）。
- 我們對透過本服務舉辦之任何活動現場發生之事不作擔保。
- 驗證、審核與檢舉工具皆為盡力而為，並非萬無一失，偶爾會漏掉、也會誤判。
十三、責任限制
於法律允許之最大範圍內，Incultnito LLC 及其負責人、成員、員工與承攬人對任何間接、附隨、特別、衍生、懲戒性或懲罰性損害，或利益、收入、資料、商譽或其他無形損失均不負責，無論該等損害是否因你使用本服務或經由本服務舉辦之實體聚會所致。
對於我們可能負擔之直接損害，我們對你之累計總責任以下列較高者為上限：(a) 引發請求事件前 12 個月內你支付給我們之金額，或 (b) 100 美元。由於本服務目前免費，通常即為 100 美元。
部分法域不允許某些責任限制。若法院認定上述某項限制對你不適用，其餘限制仍於法律允許之最大範圍內繼續適用。
十四、損害補償
你同意就第三人因下列事項提起之請求、要求、損失或費用（含合理律師費），出面抗辯、賠償並使 Incultnito LLC 及其負責人、成員、員工與承攬人免於損害：(a) 你違反本條款或適用法律使用本服務；(b) 你張貼之內容；(c) 你於任何實體活動前、中、後之行為；或 (d) 你侵害他人權利。
十五、準據法與爭議解決
本條款以美國懷俄明州法為準據法，排除其法律衝突規則。Incultnito LLC 註冊於懷俄明州。
如有爭議，我們先嘗試直接解決。請寫信至 [email protected]。若 30 日內未解決，將提交雙方合意之公認仲裁機構，依其規則於懷俄明州或以遠端方式進行個別具拘束力之仲裁。雙方均拋棄陪審團審理與集體訴訟之權利。
小額訴訟例外：本條不阻止任一方於有管轄權之小額訴訟法院（包括你在台灣居所地）以個別方式提起訴訟，惟該案件須留在小額法庭並以個別方式處理。
若你居住國之消費者保護法給予你較本條款更強之權利，該等權利對你仍然適用。
十六、條款變更
我們可能因新功能、法規變動或修正錯誤而不時更新本條款。重大變更時，我們會在此公布更新後條款並標註新生效日，並於變更生效前至少 14 日於 app 內通知你（法律或安全因素需立即生效者除外）。新生效日後繼續使用本服務即視為接受更新後條款。
十七、其他
- 完整協議：本條款加上隱私權政策即為你與我們就本服務使用之完整協議。
- 可分性：若本條款任一部分被認定為無法執行，其餘部分仍然有效。
- 不放棄：我們未立即執行某項權利並不代表放棄。
- 讓與：未經我們同意，你不得讓與本條款；我們得讓與給承繼業務之繼受人。
- 通知方式：我們可透過 app 內、推播或你帳號上之 email 聯繫你。
- 標題：各節標題僅供方便閱讀。
